QUESTION

Overpaid wages from employer

Asked on Nov 18th, 2014 on Labor and Employment - New Jersey
More details to this question:
I recently left my job. I was verbally told in order to receive payment for any residual PTO all I had to do was give two weeks notice, which I did. Now my former company is asking for the money back citing that I wasn't employed for a year. Apparently it is written In the employee handbook which I have never been provided a copy of. I told them I had not been informed of this policy and would not be returning the money. Am I required to return it? They are threading to send it to collections if I don't pay, can they do that? Please help me!

the employer has the upper hand in that the policy is in the handbook [i would check] and can harass you witha collection effort. i would check the language in the handbook to see what it says. i would negotiate a settlement. ed dimon
