QUESTION

Overtime for salary position

Asked on Aug 24th, 2013 on Labor and Employment - Ohio
More details to this question:
I am an Ohioan who works at a GM dealership in the parts department. I get salary based on 40 hours and a small camition check paid monthly. I have a set schedule of 45 hours a week. Sometimes I am required to work early mornings which adds 7.5hrs to the week. Also, I have to work two Saturdays a month which will add another 10hrs to the week. So this week alone I'll work 65 hrs and get salary based on 40?! Is this right/legally?

depends on if you are a salary exempt worker, meaning exempt from the fair labor standards act. Exemptions are based upon the job you worked in and your duties. If you are an exempt employee then you can be expected to work hours in excess of 40 per week without overtime pay. Some employers misclassify employees though in order to avoid paying overtime.
