I have worked for Snyders-Lance pre merger (5 yrs) Based in Charlotte NC but work in georgia and have been provided a document stating my position has been eliminated due to them creating a new position to cover 1 duty of mine. In the document i am being offered to transition to a lower position within our "Operations" Contingent upon my performance and attitude. The effective date is 2/1/15 and it is a 22% paycut. I have no significant issues with my performance and in fact have received a GLEAMING review this past year. is this legal? do i have any other options but to refuse this position and find another job? (I have child support and bills surrounding the passing of my wife 2 year ago i am trying to make along with normal living expenses)
In Georgia, an employer may fire, demote, or change your job (unless you have some sort of employment contract); however, and employer cannot make these decisions for discriminatory reasons.
