I am a software Trainer for a Teletronics company. I make $25,500 a year as a salary worker. I’ve done some research and I figured out they consider me an Exempt Employee since I do not get paid for overtime. I am a type One Diabetic. Therefore, I have a doctor’s appointment every 6 weeks. I usually take a half-day for these appointments since blood tests are usually involved. My employer deducts these half-days from my PTO. Is this legal?
Yes. They can deduct this time as PTO. If you ever need an extended amount of time off, you should fill out FMLA leave. Even your half days would be covered under FMLA, but the employer can deduct PTO for the time missed.
Whether you are properly classified as an exempt employee depends on your job duties. You may want to consult with an employment attorney about that because employers often misclassify employees in order to not pay overtime.
