severance pay

More details to this question:
job departure for a sales representative whom worked for approx. 13 years with a steel service center company. Reason for departure is job descriptive differences with company president and CFO who is same person. Employee was a salary paid manager with a agreed amount of 1.5% of gross profit to be paid 50% at end of year and balance in next quarter of year, So; Sales bonus program is in question? I have found new employment with direct competitor , but feel should be compensated for 10 month of work from former employer. Bonus amount in question could range in excess of 20K? Am I beating a dead horse here? ----- JIM

If I understand your question and surrounding facts, you are hoping to recover the bonus.  The terms of your agreement regarding your compensation would be the first place to look.  If the agreement is in writing, there is probably some provision that states whether you must still be employed in order to receive the bonus.  If there is such a provision, and especially if the bonus is described as being discretionary, then you may not have a claim for the bonus.  It would be best to meet with an attorney to review this in more detail and it is certainly worth your time to at least consult with an employment law attorney.
