Is it legal for a company to fire an employee when their 6 months of short term disability runs out and their doctor has not yet released the employee to return to work? I had major shoulder surgery and had to go on short term disability. My employer told me if I rolled over from short term to long term I would be terminate d. My doctor has not released me to return to work yet and he has me schedule d to return to work 2-4 weeks AFTER my short term runs out which I was planning on going to long term to cover the few extra weeks but my company said I would be terminate d. You may want to contact an attorney and send your employer a letter requesting that they engage in the interactive process and provide you with the reasonable accommodation of 2-4 additional weeks beyond the expiration of your short term disability. In the letter, I would reiterate that you have been told you would be terminated if you were unable to return to work without restrictions following the expiration of your short term disability. It is important that your physician put the 2-4 week timetable in writing to your employer and not leave it up in the air as an indefinite leave.
