QUESTION

Should I be getting on call pay while at home?

Asked on Sep 08th, 2018 on Labor and Employment - Ohio
More details to this question:
Hello I was wondering if I should be getting paid for being on call at home. While at home I have to respond to work phone calls and voicemails and if a client calls needing workers I would have to drive to the office and put in the order and recruit for the order. Also on my days off while being on call I would have to drive back to the office multiple times during the day to pay out gas money to associates.

It all depends on whether you are hourly or salary and also what your job duties are as to whether you are exempt from receiving overtime pay. If you are hourly and/or non-exempt, then you should be compensated for your time spent working at home - meaning the time when you are receiving phone calls and voicemails and responding to them. In addition, if you are having to drive to the office and complete work there, then you should be compensated for this time as well. You should also be getting paid for work on your days off.
