My daughter who is a waitress was sexually harrassed at work by an employee. She explained the issue to her manager stating he made her uncomfortable not realizing he was sexualling harrassing her. She figured he didn't mean to but the manager stated that was harrassment. Now I understand needing both sides of the story but in this case the manager didn't do much bc she was transfering to a diff restaurant the next day. Again he harrassed my daughter and again my daughter stated something to the manager who stated it will be taken care of my daughter had to work with this individual several times after that and eventually cried telling me she didn't want to go back to work bc she felt like nothing was going to be done. Now my daughter is afriaid to apply at other restaurants in fear that it would get back to other people in town about her causing problems. This is a semi big town but restaurant employees always seem to know each other. What should I do. It hurts to see her upset
When an employee sexually harasses another employee and the victim of the harassment reports it to her supervisor or manager, the company is then under a legal duty to investigate the problem and discipline or fire the perpetrator. At the very least the two should not have been working together after the manager became aware of the situation. It appears that your daughter's company did not take any of the aforementioned remedies and consequently the store is probobally liable. I have done many of these cases in Texas and in Florida and liability looks pretty solid here.
