I filed a complaint with my company about a supervisor attempting to hit me, they made him apologize but said I should have got the work done more timely. This was on film. Then after that they scheduled me with this supervisor 3 out of 4 days to work with, then he would wait until 5 minutes till shift end 8PM & assign me a job & told me I had to have it done by morning which took 5 hours. Also he would yell at me over our radios for the entire staff to hear. And then he would call me into the office & tell me, "maybe it is your age that is holding you back" you are a nice person on a friendly basis but your age is interfering with your job. He did this on numerous occasions. He would yell & swear at me in front of customers and employees. What can I do? I had to go out on medical leave because I could not breathe and my weight dropped down to 82 lbs. He also did this to another employee & she was 57 & she transferred to another store but is like me so intimidated she & I cant function
The conduct of the supervisor, by itself, is not unlawful. Your employer's HR department and management are aware of that which is why they did not do more. However, the conduct could be unlawful if, and only if, it is being directed to you due to any of the following: race, color, sex, national origin, religion, disability or age if you are 40 or older.
I cannot tell, but it sounds like this might be happening to you and another person because you are over the age of 40 or perhaps because of a medical condition (disability). If so, you should speak to an experienced employment attorney immediately.
