QUESTION

suspended from work

Asked on Aug 23rd, 2014 on Labor and Employment - Ohio
More details to this question:
My husband was sent home one day for taking a smoke break. He worked three more shifts then was written up and suspended for the orginal incident of taking a one break . Also in the write up they included a call off from a week prior. I was wondering if that is legal since he worked days in between and got in trouble twice for the same thing.

Employers have great discretion to discipline employees as they see fit. Unless there is an alternative unlawful motive for the action the employer is taking, then nothing you have stated is against the law.   Ohio employment lawyer www.mcoffmanlegal.com
