I will try get right to the point. I was hired in 05/05/2014 as a Sr Program Mgr at an aerospace company. My manager was giving me a hard time about relocating for the company, I had worked that out in my deal and he wanted me to take PTO time to do it. You can't even take PTO for 60 days. Anyway, he assigned 6 projects to me in the first 2 weeks, the largest projects the company has ever had. Then added another huge acquisition project consisting of 20 more companies. I told him it was too much for one person, he raged, screamed, etc. I went to HR and filed a complaint after 4 weeks on the job. I told them he was threatening me, harassing me, and making my job almost impossible. They said he could be very hard to get a long with and they would take care of it. Well, they never checked back with me like they said they would. 85 days into my 90 days, they terminated me after the manager found out on the complaint. I never missed a day, etc. Do I have a case against them?
Harassment is unlawful only if it is based on race, color, sex, national origin, religion, disability or age 40 or older. A complaint to HR is not protected unless the complaint is about unlawful conditions. This means that unless you complained the "harassment" was on the basis of one of the seven factors about, the company can lawfully terminate you.
