I recently completed the mortgage licensing process in order to obtain a mortgage license in the State of North Carolina and was hired by Starkey Mortgage on April 15th. On June 27th I was terminated by Starkey Mortgage do to the fact that Starkey Mortgage has offices in the State of Georgia and Georgia does not allow anyone convicted of a felony (in my case drugs) to work in the mortgage industry. I was not employed in Georgia or did I try to obtain a mortgage license in Georgia however, Starkey Mortgage did operate in Georgia and was told that I could no longer be gainfully employed with Starkey Mortgage because of Georgia's laws. I believe that I was unfairly terminated by Starkey Mortgage as I informed them of my felony before I was hired and the felony had no baring on my obtaining a mortgage license in North Carolina which I currently have.
You can file a wrongful termination lawsuit only if you can show that the employer was motivated by unlawful discrimination or unlawful retaliation. Based on the facts that you provide, I do not see any claim for wrongful termination.
