My employer has been indicted and released on bond for tax evasion. Their bank account is frozen until the FBI resolves the case I imagine. I deposited three payroll checks and they all bounced leaving my account overdrawn and the strong possibility that I will be homeless soon. I also have back pay that has yet to be given to me as well as past commissions. I keep getting the response "We are all experiencing hard times".
You can file a suit in court or with the Illinois Department of Labor for your back pay. BUT, it seems that you may have a problem collecting if the company or the owner has no money to pay what you are owed.
Although you are referred to as a 1099 employee, that may not be the correct designation and it might be that you should have been classified as an employee and paid appropriately, such as overtime if you worked overtime.
