QUESTION

What can I do?

Asked on Nov 17th, 2016 on Wrongful Termination - North Carolina
More details to this question:
I was recently fired after being promoted and getting my raise. The manager says that it was due to my background check but it hasn't changed from 09/28/2016-11/15/2016. It is exactly the same as it was when they hired me in September. Since i was fired the manager and her husband has contacted me and my boyfriend harassing me for calling corporate about the situation. I have asked them to please keep things professional but they are still continuing to contact us. I have three small children to take care of and do not know how to handle this. I turned down a job offered to me last week because the DM and GM said they needed me where I was. Please get back in touch with me, I would greatly appreciate it. Thank you for your time.

This is an employment-at-will state which means you can be fired for any reason and there is no liability for the employer unless there is an unlawful motive for the action taken against you. There are generally only two forms of unlawful motives: unlawful discrimination or unlawful retaliation. Discrimination in employment is unlawful if it is due to race, color, sex, national origin, religion, disability or age 40 or older. Retaliation in employment is unlawful if you engaged in one of a handful of "legally protected" activities and were fired for engaging in that activity. If either of these was the motive for the termination, then you may have a claim for unlawful termination.By itself, there is nothing unlawful about firing you due to a background check whether the background check has changed or not.
