I was working for a company - paid by salary - for 2 1/2 years. Starting 1/1/2017 I was told I would be paid commission on my sales only. I have not received a penny so far - I finally spoke to the owner of the company last week who told me he doesn't owe me anything based on the fact that I was working under a "draw" system - basically that I am not owed anything until I pay the company back 100% of what they paid me the past 2 1/2 years. I was never told that - I was always under the impression that starting 1/1/2017 I was to be paid commission on my sales.
Any arrangement you decribe must be subject to contract. Otherwise you must be paid at least minimum wage for your work. Thus, you can sue and/or file a complaint with the NYS department of Labor.
