I have a friend that works in Loss prevention for a major retail company. Recently he was in a situation where he was trying to apprehend a group of shoplifters. They made it out of the store before he was able to approach them, when he went outside after them, they started to run. Now this company has a policy against chasing, so he ceased pursuit once outside. He noticed mall security and went to apprise them on the situation. He stepped off the curb to do so. Because he "stepped off the curb", even tho no longer in pursuit, he was reprimanded. This consisted of suspension, and now, possible termination. He has a spotless record with the company (0 verbal warnings, 0 write up). Also the company tried to dictate to him what he was to write in a Voluntary Statement (Which to my knowledge is illegal) so that it justified the suspension and termination.. I am wondering if this is considered "wrongful termination", and does he have a lawsuit (if terminated)?..

The key to success is careful and written documentation of what took place. Your friend must make a clear and specific record with the employer using fellow employees and mall security and cameras if the actions were recorded. Was this captured on camera ? We can review the video and statements of the witnesses. The key is not what happened but what you can prove happened. Ed Dimon
