Hi I was just wrongfully terminated from an off-the books job, which Ive been working for 2yrs. Its a seasonal job and I was scheduled to work for the rest of the season. However, i was terminated when I informed my boss, that I could not work the next day due to the shift ending so late and my returning home at 3am, which I would have to take public transportation so late and had my regular employment to go to, the next day at 5am. I gave this employer contact info for someone who was willing to work my shift so he wouldnt be short. This employer had me working for 18hrs straight each day without a break and I couldnt work the following day...with that kind of exhaustion to work at my regular job. So the next day, when I pressed for my pay the employer withheld a portion of my pay with the excuse of a nametag. Is this legal? I live in NY but the job was in New Jersey.

the problem is that this is 'off-the-books' employment. the NJ Labor Department will not enforce 'secret' deals. both the employee and the employer must follow the law. ed dimon, esq.
