QUESTION

Is this misconduct? How do I find out if the detective has been imvestigated before for not follow rules?

More details to this question:
In 2013 my husband got a possession of .1 g of cocaine after being searched by an officer who claimed to have approached the house because our dog was in the road. Officer told him he would call him the next day to see if he wanted to be an informant, my husband told them he couldnt because he had kids. So the next day they came after the call and arrested him. However, the report does not say that, it says that he was arrested the same day as the search. We are looking into this because this arrest on his record is preventing us from beginning his citizenship.

Not misconduct if your husband had ANY cocaine on him period. If he chose not to be an informant for some leniency, he chose to take the charges and thats what he got. The date of arrest is likely of no consequence to ICE/INS.
