Officer emailed my ex husband

I was pulled over and arrested for a DUS , while with my boyfriend my ex husband emailed the deputy that pulled me over asked details about the traffic stop and arrest. The deputy told my ex that 2 clear glass pipes commonly used for Methanphetamines were in the vehicle. There is nothing in the incident report and now I am fighting a family court battle just to have visitation with my son. Do I have a case ? I don't know anything about anything in the vehicle nor was I charged with any drugs . I do not have any prior drug charges , or DUI my DL was suspended for administrative reasons .

Law enforcement officer's have various protections from libel, slander or defamation actions while carrying out their investigative duties and creating incident reports. When a law enforcement officer makes statements to third parties outside of the realm of department procedures, questions of libel, slander and defamation may exist. Law enforcement officers are barred by Federal Law from acting with their position of authority to violate a persons rights.
