I had purchased a plot few years ago at a cemetery. When My husband died November 2019 there was no space beside that plot for a double plot so I traded that lot for a space where there was a double.. I buried him at a cemetery and purchased the lot next to him for myself. I went to purchase his head stone today and found out that they had recently mistakenly buried someone in my plot beside my husband. I am devastated. Make it worst they are telling me that they have move my husband if I want another one beside him. I am an emotional wreck over their negligence Move my husband elsewhere .

Yes you may have a case. I have done many of these cases in the state of Florida. In Florida, the general rule is that in order to recover for emotional distress damages in any personal injury case, you have to prove a physical impact. The exception to that rule is when a cemetery or a funeral home commits any kind of misconduct, whether that be negligent or intentional. You should retain counsel here in Florida on contingency fee, which means you don't pay anything unless you win the case.
