QUESTION

Filing for Legal Malpractice

Asked on Sep 17th, 2015 on Legal Malpractice - Ohio
More details to this question:
My son's divorce complaint was recently dismissed by the Court due to not being filed as "in rem". My son's counsel was provided with a copy of his out-of-state Separation Agreement. All he wanted was to be divorced and have the Court take jurisdiction over the marital status only. His counsel drafted and filed a standard complaint with the Court requesting Order for Parenting Time, Reasonable Division of Debts and Assets and such other relief. All of these things were previously resolved in another state and drafted and signed into a Separation Agreement; which was provided to son's counsel. My son has now incurred a financial loss of over $2000 (includes defense counsel's legal fees, court costs, and non-refunded counsel's retainer) due to his counsel's error. This may be a small amount to law firms, but the amount is HUGE for my son. How do we find an attorney to review his case?

Since there was a non-refundable retainer charged, this may be something for review by the local bar association ethics committee.  I recommend that you contact either the local bar association to speak with bar counsel to see if the bar association could assist you. Not the best answer, but likely the only real option.
