QUESTION

Have my rights been violated?

Asked on Jul 05th, 2018 on Legal Malpractice - Florida
More details to this question:
I was arrested January 5, 2018 in Citrus County on an outstanding warrant out of Leon County on the charge of "lewd and Lascivious acts upon a minor age 12-16. I was never given my rights, questioned or was an affidavit supplied to me explaining the charges. Went through first appearance and was assigned a public defender since my attorney was not present.I could not get his name from my wife due to the restricted nature of my incarceration. Bond assigned at $50,000, conditions of release was GPS, and supervision necessary if around children. I had no opportunity to read the affidavit and was given only initials in order to ascertain who was charging me. It turns out that the arrest was from 28 years ago, made by my step-daughter and no corroborating evidence. I was released under the pre-trial restrictions and returned to my home in Citrus County. I was subsequently re-arrested on January 26, 2018 on the allegation that I had violated the pre-trial release conditions. Case dropped

Not from the facts presented. It seems you may have issue with the step-daughter - if the accusations are false. Not sure why you were re-arrested or the charges dropped and those facts could provide addditonal assessement.
