Asked on Oct 10th, 2016 on Legal Malpractice - Kentucky
More details to this question:
I live in Floyd County Kentucky. I've been divorced for 11 years after being married for 10.5. My ex is a state police and I'm not comfortable asking a lot of questions here. Ive recently found out I could've received half of his pension. She NEVER brought this up to me during the divorce.its in mine of our papers. Is it possible to have a claim against her for legal malpractice/ negligence Could I still be entitled to any of his pension. He doesn't pay into social security only a retirement thru his job. Im only looking for information I realize this isn't legal advice. Is there any direction. You can point me in with this. Thank you Jennifer Sammons

Clearly, you need to retain a divorce lawyer to determine whether you can still obtain a QDRO -- qualified doemestic relations order.  I just do not know the answer. You may have a legal malpractice claim against your prior lawyer.  My advice would be to contact the Kentucky Bar Association fo a referral in your general vicinity.
