QUESTION

Am I Better Off Settling Than Going to Court?

Asked on Jul 27th, 2019 on Litigation - New York
More details to this question:
Hello, An ex-business associate has teamed up with a lawyer working on contingency to file a suit that he (and possibly his attorney) knows to be 100% bogus. Because of our history, we have had years of access to each otherโ€™s financial situations. So: 1) This person knows I have money (or at least enough to pay if a judgement is issued against me) 2) This person knows that I know he has no money (he lives paycheck to paycheck, is deeply in debt, and his balance, when not negative, is never more than a few hundred dollars) So even that the suit is 100% winnable, he knows I have no chance of recovering my legal fees from him if I do win. They have named and two of my LLCs as defendants, so defending myself is not an option. Am I better off settling than going to court?

If you have money, why wouldn't you defend the case?  It is cheaper to defend and win than settle.

I don't think any lawyer can adequately answer your question without delving into the fact of the case.  Without an analysis, there is no way to give you any advice.  What is the subject matter of the dispute?  If you have money, I would have a lawyer analyze the case to give you some initial direction.
