QUESTION

Anyone want an easy case that’s already won?

Asked on Oct 19th, 2022 on Litigation - Florida
More details to this question:
I won a $6,000 lawsuit against an automotive repair shop, and the defendants loss her hearing to oppose garnishment of wages. And the defendant lost again in Appeals Court. The defendant suggest I get a lawyer to put together a payment plan. The defendant owns at least two auto shops and still appears reluctant to pay. Does anyone want to help? If not then do I have to set another hearing to charge the defendant for contempt of court and failure to pay? Should I call back the Consumer Protection Agency that began the case for me and was there a few months before me and would like to close down the shop? Should I call the police? This is after she spent months manipulating the court system and attempting to defraud the court with lies as is shown in both courts files.

If it was so easy, why are you asking others to do the work? That said, there is no contempt of court for failing to pay. Many times the issue is the defendant is judgment proof and that is the primary reason lawyers will not likely take the such a case on a contingent fee as they will not take the risk of not getting paid and you won't want to pay an hourly rate. You may want to contact the DMV and the Consumer Affairs folks to see if they will get involved but they will not likely enforce your judgment.
