QUESTION

Are legal fees reimbursed?

Asked on Apr 28th, 2020 on Litigation - New Jersey
More details to this question:
I am currently seeking a lawyer to see if I am entitled to money back from an exchange gone sour. I made a purchase of a product to an individual via Venmo (a money transferring app that does not allow disputing charges). The item was not received and after contacting the individual several times, it has always been delay, delay, delay. Finally three months later when we reach out for a refund, the product has FINALLY been shipped. 1. Can we reject the package and still be able to sue for a full refund even if the individual refuses to provide one? 2. If there were shipping fees that were not disclosed that the individual will try not to be responsible for, are we still entitled to a full refund? 3. Can we sue (in addition to a full refund) for additional costs accrued such as legal fees and court costs?

The key to answering the question is the contract. We would have to review the written contract and determine how these issues are addressed. Did you purchase the item from a corporation ? From an individual ? Please call to discuss. Ed Dimon, Esq. 732-797-1600 ext 235
