QUESTION

Beneficiary Rights

Asked on Mar 02nd, 2020 on Litigation - North Carolina
More details to this question:
I am 1 of 3 beneficiaries involving an estate from our parents. I have been here in NC taking care of my parents for 30 years. My brother and his wife sold their house and moved in to help with our father who had lung cancer and had been living with him for 4 months (Aug. 2019-Jan. 2020) they currently live in the house and want to continue living in it. We all have a third each. One of my brothers is forfeiting his third of the house and property and they feel I should do the same. I don't agree. It is a Ranch style house on 11.5 acres of land involving a rental house, large garages with tractors and a gator. My sister in-law has been in the house by herself for a few weeks while her husband (my brother who is the executor) Keeps posting she is cleaning house and getting rid of things without us there. What are my rights and do I need a lawyer? The lawyer that was hired by my father does not return my calls with simple questions. He only corresponds with my brother. Please help!

The lawyer hired by your brother presumably represents your father's estate and its executor, not you.  If your brother the executor can't, or won't, answer your questions to your satisfaction and you feel that you need an attorney to protect your rights, you will have to hire your own.
