QUESTION

Broken tooth from chicken bone

Asked on Apr 07th, 2014 on Civil Litigation - Virginia
More details to this question:
I was eating a chicken salad wrap when I bit down and broke the corner of my tooth off. There was a 3/8 inch piece of chicken bone it it. I immediately went to a dentist and he did not believe there was significant damage - but it is chipped and may need some work. A claims adjuster called for the company and said that small bones are expected from time to time in meat products, so they are not liable. But since I have been a long time member (warehouse store) that they would provide me $100 to offset some of the costs. I told them I appreciated any help they could provide (i.e. I accepted it) this afternoon. Did I do the wrong thing?

The claims adjuster was full of baloney-they are liable for foreign objects...but having said that, taking the $100 and getting it fixed is probably a good idea  as the damages aren't expensive enough to justify spending money on a lawyer.  In my humble opinion, you made the right call.
