Can a lawsuit be amended?

More details to this question:
My 2nd lawyer agreed to take my case. I paid him $5,000.oo retainer. He has done nothing for 18 months and now tells me I should settle at what ever the other side offers as my lawsuit has defects written by the 1st attorney. If it had defects, shouldn't the 2nd atty have amended the lawsuit? Something is not right here!

Pleadings can be amended, but unless the amendment is sought within a very short period of time, the consent of the other side, or permission of the Court, is required to amend.
