Don't give it to the band director, give it to the school or school district with the restriction that it be used for band equipment.

I do not know the answer. I suspect this is not governed by any law, but may be governed by School Board Policy. I suggest you go ask a member of the County Board of Education. They are elected officials who usually like to connect to citizens. One option may to not give it to the band director, but direct to the school, to be used for this purpose. Or, the band director could pick the instruments, and you simply pay for them and donate them to the school.

If he is actually your teacher and responsible for grading you, I would not do it because it creates at least an appearance that you are buying a grade... at least trying to influence him. If your motives are genuine, I would suggest that you make the payment to the principle and ask that it be used for band equipment.

Give the money to the school and specify what your "gift" must be used for.

Use should donate it to the principle, with the purpose specified.

What you propose to do very likely violates an employment rule of the school district. Perhaps instead of making a gift of money you can organize a school-sanctioned student activity to raise funds?

You would have to ask the teacher but I would suggest that it be donated to the school, not a teacher individually as that is going to raise the issue of favoritism or possibly gaining favor.
