QUESTION

can a warrant be issued for a returned summon in the state of ky?

Asked on Mar 10th, 2014 on Civil Litigation - Kentucky
More details to this question:
I was at work and a sheriff came to the door with summons papers for me. My husband was home and he explained I work night shift. Sheriff said if I don't contact him soon a warrant will be issued. Can a warrant be issued even though they have not properly served me? This is the first I heard about it.

I am not familiar with Kentucky law specifically, but in the jurisdictions in which I practice, delivery of a summons to a competent adult at the home of the person to be served is valid service (an added mailing may be necessary.)  Unless Kentucky law is different, delivery to your husband at your home can be good service.
