can I serve the wife?

Hi, Im from colorado an was scammed out of 2300. I have already filed for small claims an have all the paper work. This man who scammed me is an was married at the time. I've hired a private investigator an spent over 1k to find this man to serve him. Which has been unsuccessful. His wife an him are separated an lives in San Antonio Texas.  What I am wondering is am I able to serve her since she is his spouse?

Probably not.  If the husband and wife are separated and not living together service on the spouse will not likely be sufficient.  Additionally, if you intend to bring your case in CO, serving the parties in TX is unlikely to create jurisdiction for the CO Courts.   If you want to bring this case you should consider hiring an attorney to assist you.
