QUESTION

Can I sue for damages to my vehicle while in impound

Asked on Dec 02nd, 2020 on Civil Litigation - California
More details to this question:
My car was impounded since 11/2/20 and got it released today 12/2/20. Never had any issues with my vehicle and just had it serviced at the dealership. After starting the vehicle at the impound place, the check engine light was on and the engine sounds horrible. Turns out there’s multiple codes going off that I had never had issues with until after my car had been sitting in the impound for 30 days, I paid all my fees which was over $2,000 dollars to the impound yard, I’m still paying for the vehicle and it seems they drove the car because the mileage doesn’t add up either.

Yes, if you have proof of the damages (which it appears you do) and the damages are under $10,000, then you can file a claim with the Small Claims Court and represent yourself.  The Small Claims Court has set up an easy procedure meant to assist claimants to collect amounts under $10,000.  You can look on-line for how to file a small claims.  Attorneys cannot represent persons in a small claims case.  Good luck!
