Can i sue if the seller did not meet requirements?

More details to this question:
We paid for a mobile home trailer and the delivery. He got it stuck in the middle of the driveway, broke the axle and frame to it so it is rendered useless. He said he would come back tomorrow with someone with a bulldozer. Never came, contacted him and told us he's not going to help and cannot be bothered with it.

Was the seller an individual or a company who sold mobile home trailers? Was the delivery person employed by the seller?
