QUESTION

Can I sue my defense attorney in Florida?

Asked on Feb 09th, 2023 on Litigation - Florida
More details to this question:
I had a criminal case that was mishandled by my defense attorney. I would like to sue that attorney for damages. I am appealing my case and had he provided adequate representation, I would not have gotten a much more harsh punishment than was offered by the state. He failed to depose any witnesses or create a defense. He failed to advise of me of a plea deal offered by the state. He failed to advise me of immigration consequences of taking a plea deal. I had to hire another attorney to help me but it was too late. I can document all of this and damages in excess of $300k annually from a business that was lost due to my punishment.

Sure. If you can prove the lawyer was negligent and was the cause of your damages, as opposed to the State's successful prosecution. Whether you win or succeed, or its worth the expense to pursue such a case is a different issue.
