I represented myself in an arrears child support case where my ex wife had an attorney. At the time I had applied for SSDI because I have severe lower back problems and was diagnosed with Menieres Disease. At a status hearing her attorney told me to contact hiim before the next status date and let him know if there was any progress, cause if there wasnt he didnt want to waste his time coming to court. I was having severe drop episodes of vertigo and had a scheduled surgery to have Endolymphatic shunt sac/decompression surgery the friday before the status hearing was the following mon. I explained to him that I was not supposed to be mobile for several days after the surgery and wanted to confirm he was rescheduling. I did not hear back and the day of the surgery my ex texted me and said they were not cancelling. That monday I had to use a cane and had bloody head dressing on to court. I do not remember being there and my wife had to assist me. I then had several days of falling
The lawyer doesn’t dictate when court dates are, the courts do. If you were unable to have come to court due to a serious medical issue, you should had contacted the court directly by notifying the court clerk of the reason you couldn’t make the court date and requested to have appeared by telephone or have requested an adjournment of the hearing. So, in my opinion you have no legal cause to sue your ex’s family lawyer. I certainly understand why you were upset.
