Can I sue the Sheriff's Department in state of Texas

My daughter was raped 3 years ago and there was nothing done about it a report was filed I followed up with counseling with her and everything and there was nothing done about it to the individual that raped her by the Sheriff's Department

It is the District Attorney's job to prosecute crime. You should talk to someone in the DA's office to find out why the case wasn't referred for prosecution. There may be a problem with the evidence in the case.
