QUESTION

Can I sue them?

Asked on Aug 13th, 2013 on Civil Litigation - Oklahoma
More details to this question:
I was arrested in Glenpool for a garage sale sign. After posting $110 bond, I was released. I spoke with our Mayor and he told me that I should have never been arrested and apologized for it happening. The city attorney then contacted me and apologized. He also said that the code was never meant to have someone arrested, and all my money would be refunded. I've talk to several people about what happened (getting arrested in front of several neighbor children) and several people have suggested that I contact an attorney and see if I should sue them. I have never sued anyone, so I don't know how I should proceed, or just let it go. Thank you for any advice you can give. Thank you.

This would have to be either a governmental tort claim or a Section 1983 civil rights claim. Either way, I question whether you have actual damages sufficient to support a viable civil case. Brian Huddleston
