QUESTION

Can I take a car dealership to small claims?

Asked on Sep 14th, 2020 on Civil Litigation - Florida
More details to this question:
I purchased a 2015 VW Golf GTI Turbo from the St Augustine VW dealership in 2018. 2 weeks ago I found out the shipping blocks were not removed from the wheel well of the vehicle. Due to the shipping blocks not being removed I have to replace all 4 struts. I received a quote of $1040 for parts with 3.5 hours of labor. I have been on calls with VW Corporate, St Augustine dealership as well as West Palm dealership (where the car was originally sold from). St. Augustine and West Palm are blaming each other and corporate can only help me "open the lines of communication with the St. Augustine dealership. I feel that St. Augustine is responsible as they do a 150 pt inspection prior to selling to me. Their excuse is that the car was so old that they didn't think to look for the shipping blocks. I do not feel this is my responsibility to pay for their mistake. I, now, live in NY so this has been very aggravating and I cannot get anyone from VW to own up to this error.

Its a $1000.00 issue and every viable option will cost you that much or more to address. If it can't be resolved as a CS issue - you move on and it is what it is.
