QUESTION

Can I throw away my ex-girlfriend's stuff if she says she doesn't want it?

Asked on Dec 09th, 2015 on Litigation - Utah
More details to this question:
My and my girlfriend broke up. I have told her numerous times to come get her crap, but she chooses and says she doesn't want it. If I have photographic proof that she says she wont come get it/want it; am I allowed by law to dispose of the stuff how I want or would that be vandalism I want to make sure. I have enough legal issues without this stuff hanging over my head.

There is statutory procedure that must be followed before disposing of abandoned personal property. Basically, you have to give her thirty days written notice that she has to pick up her property. At the end of the thirty days, you can sell the items or donate them to a charity. Before doing anything, I would recommend meeting with an attorney to go over the statute thoroughly so you do not get into trouble down the road.
