QUESTION

Can my ex throw my stuff away? What should I do about this?

Asked on Nov 25th, 2013 on Litigation - South Carolina
More details to this question:
She has some of my stuff still from when we split up several months ago. Since I had to move an hour away, I haven't been able to go and grab it. However my dad lives in the same town as her and I've been trying to get her just to drop it off at his house seeing as I don't own a car anymore. She has threatened to just throw it out if I don't pick it up and now she might actually do it. Can she do it legally or is it something I can get her on if she does?

She has to keep it for a reasonable time and make it available to you for pick up, which it sounds like she has done. She does not have to deliver it to your father's house. You need to arrange with her to get the items.

Have your dad go there and get the property. She does not have to keep it forever.

Why would she have a burden to do anything. Send your dad to pick up your stuff or hire somebody to do it.

She can tell you to remove it or have it removed and if you do not it will be thrown out. Why do you think she needs to store it for you under the described circumstances.

You have abandoned the stuff. She can toss it out. Get your dad to pick it up. You cannot compel her to deliver it anywhere.

The easiest way to resolve the problem is to simply get a friend to pick up the stuff or rent a truck and do it. Your ex is under no obligation to pack up and deliver your stuff. She has been keeping it for several months go get it.

She can't throw your stuff away, you have not abandoned it. Ask her when your father can go over to her place to pick it up.

It may depend on what you mean by my ex. If it is ex girlfriend, and the stuff is yours, you could possibly get her for breach of trust, larceny, or malicious destruction of property, but the police will probably decline to bring charges in that t it is a domestic squabble. If it is ex wife, it might depend on what your divorce decree states in regard to this property.
