can my husband be sue for not answering personal question on a sepena

my husband is being sue by lawyers who are working with a collection agency the lawyer sent a notice from him an a county clerk I wrote back to both men my husbands very sick since last july of 2012 he has lung cancer diabeties copd among other issues he was in an out of the hospital 3 times he was off of chemo for 2 months his fingers an toes are numb any excitement or stress could land him back in the hospital he is now strating chemo again low dose they are threatening to have him arrested if he doesntanwser some personal questions or i think the letter says appear in court he can not walk well is weak I take him out once in a while what can i do to stop this over a old debt we dont know who the original crediter is an its for $1013..85 what can i do i cant afford a lawyer I thought bills over 6 years old in nj is void.

If the creditor obtained a judgment against your husband, then the information being requested is post judgment discovery.  The subpoena is a simple method of discovering assets of a judgment debtor, so that the judgment creditor can use legal process to collect the judgment from the debtor.  If your husband ignores the subpoena, and the questions are not answered, the creditor might be able to obtain a warrant to arrest your husband.
