QUESTION

Can my school legally search me without my consent?

Asked on May 05th, 2014 on Litigation - California
More details to this question:
So, I go to a public high school in California, and I'm 18. I was legally emancipated before I was even 18, and I live on my own. I smoke cigarettes and carry them and a lighter on me, in my purse. I also have a bottle of menstrual pain relief medication, which also has Adderall in it(my boyfriend takes it, and I keep a few doses handy in case he forgets to take it at home(which he does a lot)) too. It's against school rules to keep medications of any sort on you, from Neosporin to Ibuprofen to wart freeze off canisters. You're supposed to keep it in the nurses office and get doses from her. If, for some reason, they called me in to the office and wanted to search my person or my belongings, do I still have the right to say no? Would I get in trouble for any of the above items I carry, even though it's legal to buy cigarettes, lighters, and menstrual relief pills? I would understand getting in trouble for the very illegal prescription Adderall, but to be fair, it's honestly not mine.

I don't know what district you attend. Some even have metal detectors at the door. You still have some rights to privacy, but you are risking that if they come up with some reason to search you, you could suffer discipline and possible expulsion for possessing drugs, especially the adderal.
