QUESTION

Can someone file a restraining order if you've done nothing wrong?

Asked on May 20th, 2013 on Litigation - Florida
More details to this question:
A past girlfriend has been calling my house for weeks now, at least 2 - 3 times daily. During these calls, she uses very profane language and continuously threatens me with filing a restraining order against me. The thing is, I have done nothing to her, at all. The break up was clean, and at the time, we respectfully ended the relationship, but now its crazy and I feel like I should be the one filing for a restraining order. What do I do in this situation?

Yes someone can file a restraining order if you have done nothing. They would need to lie in order to get an order entered. What you need to do is get an attorney if she files a petition. You might be able to get a repeat violence injunction entered against her, depending upon the facts of her harassing you.
