Can someone use my business name without my permission?

More details to this question:
I opened a hair salon in March 2013. I've recently stumbled on someone using my business name without my permission. Is that legal?

No and you can sue them if you had the name first.

No that is not legal. Check to see if it is a registered business, if not report them. Also, send a letter from an attorney to stop using it or else you will take legal action.
