QUESTION

Can the town I live in take my dog and put her down?

Asked on Aug 31st, 2012 on Litigation - Mississippi
More details to this question:
I live in lake city Arkansas, where they recently changed the dog ordinance to not only can you not have a pit bull but now you can't have a mixed breed either. They allowed me to put insurance on her and 8 months later now they are trying to take her and put her down. She has never hurt anyone or even got out of my yard. Is there any way to keep her.

You should either get an attorney and fight the ordinance on the fact that you had the dog before the ordinanace or move out of town.

If town ENACTS a law they can also retoactively enact it to where you would "break" the law BEFORE it was enacted. You could fight this by appealing it ($1500+). Just give dog to a relative in a nearby town.

Welcome to the Nannie state, if your town has passed such an ordinance, I suspect it will enforce it.

You need to get a lawyer in Arkansas to help you. Try giving her to an out of town friend for a while.
