More details to this question:
We gave a down payment for a addition and a garage the addition didn’t happen because the man that was supposed to build it refused to because we did not hire him to also do our cement they kept a portion for his contractor canceling and the garage was not up to code so he kept that money it took 6 months to get him served and the morning of court he called and asked it to not be a small claims issue and now we are waiting for paperwork from his lawyer . We need legal counsel

You do need legal counsel. The problem is the amount of damages against the cost of litigation. If you have a written contract, it really helps as well as receipts. If he took your money, you need to amend your complaint to add a claim for conversion if you are within the tri-county/Ann Arbor area, please contact me via email.
