Co- sign for a phone

More details to this question:
I co-signed for some a phone at sprint.. The phone is turned off. Sprint wants they phone & or money.. The person will not give me the phone.. Sprint is sueing me?

You either pay or get the phone back to them - thats what co-signors do.
