Counterclaim by defendant exceeds small claims. What are my options?

More details to this question:
I have a court date for December 10. I am now being counter sued for $3500. This would no longer make the my suit eligible for small claims court. My claim is for the $500 deposit. What should I do? How specifically can I work this out without having to go to any court? If I write a letter, is it to their attorney or the president of the company that I had communication with? What do I say in the letter. Any and all suggestion are greatly appreciated.

you need to work out you claim and the counter-claim with your adversay if possible. the alternative is going to court where the judge will make the decision. i would speak directly with the attorney. no letters. i would go to court if i could not resolve. ed dimon, esq.
