Do I have a case

More details to this question:
The driver that ran into our driveway @ 2AM and totaled my mini van and put my husbands car in shop for 3 weeks and then fled the scene on foot was only charged with failure to control. Police report states open containers in his car and he ran stop sign across street from our drive way at excessive speed embedding his car inside my van and pushing van about 40 feet into back of my husbands car pushing his car about 20 feet into garage. When questioned by sheriff a ways from our house he denied being in an accident and said he was lost My van was totaled and my husband had to borrow car to get to work. Our lives were turned upside down. Causing much stress and lost income and he only gets failure to control. Do we have a civil case to replace my van and lost income?

Of course, except that the case is only for the amount of damage you suffered above what your insurance company will cover.  Your insurance company will also have a claim for the amounts it reimburses you.
